1. INTRODUCTION 1.1 These General Terms and Conditions (hereinafter — the “Terms”) govern the use of the Visit mobile application (hereinafter — the “Platform”, “Visit”, “We”), owned by Individual Entrepreneur Bohdan Hnatiuk. 1.2 These Terms, the Privacy Policy, and any other documents posted on the Platform constitute and govern the contractual relationship between the user (hereinafter — the “User”, “You”) and the Platform. 1.3 Before accepting these Terms, please read them carefully. We recommend saving or printing them for your records. If You do not agree with any part of these Terms, please do not accept them, do not create an account, and do not continue using the Platform. Continued use of the Platform constitutes Your acceptance of these Terms. These Terms become effective upon their publication on the Platform. 1.4 These Terms and the Privacy Policy apply to You once You confirm your registration data when creating an account. By accepting these Terms and the Privacy Policy, You confirm that You have read the Privacy Policy, which explains how Visit collects, processes, and may share personal data. 1.5 The original version of these Terms is drafted in English and has legal force. Translations into other languages are provided for informational purposes only. In case of discrepancies, the English version shall prevail. 2. CHANGES TO THE TERMS 2.1 Visit reserves the right to periodically amend, supplement, and/or modify these Terms. Users will be notified of changes upon their next login and are required to review the updated Terms. Users must not continue using the Platform if they do not accept the updated Terms. 2.2 Any changes take effect upon publication on the Platform. We recommend regularly reviewing the Terms and other information posted on the Platform. 2.3 If You do not agree with the changes, You have the right to terminate your relationship with Visit by discontinuing use of the Platform and closing your account in accordance with these Terms and the Privacy Policy. 3. ELIGIBILITY 3.1 The Platform and its services are available only to individuals aged 18 or older. By using the Platform, You confirm that You are at least 18 years old. If We determine that a user is under 18, We reserve the right to immediately terminate access and/or delete the account. 3.2 Visit is not responsible for use of the Platform by individuals under 18 if such use occurs with parental or guardian consent or supervision. Parents/guardians assume full responsibility for such use. 3.3 If You provide false information about your age, You bear full responsibility for any consequences. 4. ACCOUNT REGISTRATION AND SECURITY 4.1 To access certain features, You must register and create an account using a phone number. You agree to provide accurate and complete information. 4.2 The Platform may use a Telegram bot to confirm bookings or send service-related notifications. You acknowledge that certain interactions may occur via Telegram. You are responsible for securing access to your Telegram account linked to the Platform. 4.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Visit is not liable for unauthorized use resulting from your failure to protect your credentials. 4.4 You must immediately notify Visit of any unauthorized use or security breach. Visit is not liable for damages resulting from failure to comply with this requirement. 5. ACCESS AND SUBSCRIPTIONS 5.1 The Platform provides both free and paid access. Free access may include limitations such as restricted features or usage limits. 5.2 To unlock additional features, Users may purchase a subscription. Details of plans, pricing, and features are displayed on the Platform. 5.3 By purchasing a subscription, You agree to pay applicable fees according to the selected plan. 5.4 Subscriptions are billed on a recurring basis and automatically renew unless canceled. 5.5 You may cancel your subscription at any time via account settings. Cancellation takes effect at the end of the current billing period. 5.6 In case of failed payment, Visit may downgrade the account to a free plan. Subscription access may be restored after successful payment. 5.7 Visit may modify subscription pricing or plans. Changes apply upon the next renewal. 5.8 If You subscribe via the App Store or another third-party provider, additional terms may apply. Refunds and cancellations are governed by that provider. 6. PROHIBITED CONDUCT 6.1 You agree not to use the Platform for: illegal activities adult content or prostitution sale/promotion of illegal goods or services fraud or misleading practices human trafficking or exploitation intellectual property violations hate speech or violence privacy violations harassment or bullying harmful or offensive content malware, spam, phishing unlawful activities under any jurisdiction unsafe or unlicensed services pyramid schemes or unauthorized commercial models interference with Platform operations 6.2 Violations may result in immediate suspension or termination and/or legal action. 6.3 Visit may store and disclose user data if required by law or necessary to: (a) comply with legal obligations; (b) enforce these Terms; (c) respond to claims; (d) protect rights and safety. 7. CONFIDENTIALITY 7.1 You agree not to disclose Visit’s Confidential Information. 7.2 Confidential Information includes business, financial, technical, legal, and operational data, including source code, strategies, databases, and more. 8. INTELLECTUAL PROPERTY 8.1 Platform IP All Platform content is owned by Visit and protected by law. Unauthorized use is prohibited. 8.2 User Content Users retain ownership of their content but grant Visit a worldwide, royalty-free license to use it for Platform operation and promotion. You guarantee that your content does not violate third-party rights. 9. SUSPENSION AND TERMINATION Visit may suspend or terminate access without notice for violations, legal requests, fraud suspicion, inactivity, etc. 10. DISCLAIMER AND LIMITATION OF LIABILITY The Platform is provided “as is” and “as available”. Visit: does not guarantee uninterrupted operation is not responsible for errors or inaccuracies disclaims all warranties Visit is not liable for indirect damages, lost profits, or data loss. Visit is NOT responsible for the quality, legality, or results of services provided by users. 11. INDEMNIFICATION You agree to indemnify Visit against claims arising from: your content your use of the Platform violation of Terms third-party rights violations 12. THIRD-PARTY LINKS Visit is not responsible for third-party websites. 13. CLAIMS AND NOTICES Contact: support@visit.solution-da.com Response time: typically 10 business days. 14. ASSIGNMENT Visit may transfer its rights. Users may not. 15. GOVERNING LAW These Terms are governed by the laws of Ukraine. 16. DISPUTE RESOLUTION Disputes are subject to Ukrainian jurisdiction. 17. FORCE MAJEURE Visit is not liable for events beyond its control. 18. SEVERABILITY If any provision is invalid, others remain in effect.
